We Will Gather the Evidence.
Often time is your enemy. Motorcycle lawyers would like injured motorcycle riders or their families to contact us right away.
The reasons to make contact soon is so we can gather evidence. We like to visit the scene of the crash as soon as possible or have our investigators get to the scene ASAP. We look for video of the crash from nearby stores—security video usually. Gathering this video is time sensitive because the security videos are usually on a loop and will be recorded over—sometimes within 24 hours—sometimes even less.
We also speak with nearby businesses and such searching for people that witnessed the crash. Police attending to the scene of the crash usually do not have the time to do an exhaustive search for nearby witnesses. We interview witnesses and sometimes have them complete affidavits memorializing what they saw and heard.
We also need to take photographic evidence—skid marks, gouges in the road, vehicle and motorcycle damage, and sometimes, if contacted right away, the remnants of treatment at the scene.
We Will Take Care of the Paperwork.
We will of course initiate paperwork right away. We place the insurance company on notice that we represent you. This stops the insurance company from talking directly with you. This is important because we have experienced that insurance companies will call you soon after the crash in an effort to “get your side of the story.” What they are really doing of course is getting your story recorded so they can strategize a way to make you responsible for causing the crash.
We start the process of gathering medical records from the ambulance company and others that treated for your injuries at the scene. As you go through treatment we gather medical records periodically as you complete treatment.
We also handle all of the paperwork for your medical insurance. No doubt you will have an avalanche of bills arriving as your treatment progresses. We handle all of the paperwork required to keep your medical insurance intact and have them wait for payment until the case is finalized.
Behind the scenes we start to form a strategy for the case. We do focus groups with members of the public to determine the right way to present your case—either for trial or for settlement. After all, it will be ordinary members of the public that will ultimately decide your case at trial so focus groups are an essential part of what we do to prepare your case fully.
We Will Communicate with the Insurance Companies.
Insurance companies are notorious for trying to settle claims early. Of course, this is in their own selfish interest. You probably do not know the full extent of your injuries for some time. If you take an early settlement you can never go back later. Once you settle a case—that is it!
We proactively communicate with the insurance companies keeping them abreast of what is going on with you and your treatment. This too is essential because, as treatment progresses, insurance companies are required to set reserves. Reserves are the amount of money that insurance companies must set aside for pending claims. Keeping the insurance company aware of your treatment, and resulting increasing costs, forces them to increase their reserves. When motorcycle lawyers do not keep the insurance companies aware of the increasing costs of treatment it is very difficult to get a fair settlement.
We Will Represent You in Court.
No one ever really wants to go to trial in a personal injury case. I often say, “If insurance companies simply treated the people injured by their insureds fairly, I would be out of a job.” Sad but true!
When the offer to settle is simply too low, sometimes not even enough to pay your medical bills, you are left with no option but to sue and go to court. Sometimes simply filing a complaint in court will move the insurance company to start bargaining in good faith and the case will settle.
If the case does not settle you must have a motorcycle attorney who is ready, willing, and able to try your case in front of a jury and a judge. Your attorney must also be skilled in presenting cases to juries.
